Who We Serve
Smart Gen Society (“SGS”) believes everyone, especially youth, should be able to stay safe while utilizing social media and digital devices. SGS believes the education of families, schools, communities, and youth is the first line of defense for staying safe online and SGS has a comprehensive educational department for this purpose. In addition, SGS knows that no matter how safe you are, or how educated, sometimes digital crises and social media mishaps, or downright mistakes, occur or are occurring TO you. SGS has trained staff to assist you with maintaining, addressing, and resolving these situations through our digital wellness program. And finally, Smart Gen Society has partnerships with national and area organizations that together, make our services one of the most comprehensive in the nation.

Here at Smart Gen Society, we know this isn’t the most exciting section of our website, but we have worked hard to protect our staff, curriculum, services, and smartgensociety.org users, so please take a minute to review.
By using smartgensociety.org (the “Site”), you signify you agree to the following Terms of Use and Privacy Policy. If you do not agree to all the Terms of Use and Privacy Policy, please do NOT use the Site.
Terms of Use Disclaimer
Very important: The Site DOES NOT provide medical, legal, or mental health advice. All material, including text, images, information, blogs, reviews, articles, and all else (“Site Content”), is for INFORMATIONAL purposes only. Please reach out to a professional for medical, legal, or mental health questions. Reliance on any Site Content found on or provided by smartgensociety.com, its employees, or affiliates, is at the user’s risk.
By using the Site, you agree that:
- All information submitted on your behalf is truthful and accurate;
- You will not submit any personal information if you are under 13 years old (please see COPPA compliancy under “Gathering of Personally Identifying Information” below); and
- Your use of the Site does not violate any applicable law or regulation.

Use of Content
Unless otherwise indicated, Smart Gen Society or its partners own all content on the Site. This means all copyrights, trademarks, service marks, designs, text, graphics, layout, logos, pictures, audio/video clips, information and data on the Site may not be used or reproduced without explicit, written consent from Smart Gen Society (collectively, “Content”).
Content cannot be used commercially, resold, redistributed, reproduced, displayed, republished, digitized, translated, modified, publicly displayed, publicly performed, or used for other than its intended purpose.
Smart Gen Society in no way gives permission to intellectual property rights, for any reason, without explicit, written consent. Nothing in the Terms of Use or Privacy Policy should be construed as such and Smart Gen Society may terminate your access to its site at any time for any reason. If this occurs, you agree that Smart Gen Society shall not be liable to you or any third party for terminating your access to the Site.
Liability and Indemnification
By using the Site, you agree to defend, indemnify, and hold smartgensociety.org, Smart Gen Society’s officers, directors, board members, employees, and agents, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, result from, or alleged to result from, your violation of these Terms and Conditions and Privacy Policy.
Governing Law
The Terms of Service and Privacy Policy (below) are governed and construed in accordance with the laws of the State of Nebraska. You irrevocably and unconditionally consent to the exclusive jurisdiction of the state and federal courts of Nebraska over any action or proceeding relating to use of the Site or the Terms of Use and Privacy Policy.
Privacy Policy
Website Visitors
Like most website operators, Smart Gen Society collects non-personally identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Smart Gen Society’s purpose in collecting non-personally identifying information is to better understand how Smart Gen Society’s visitors use its website. From time to time, Smart Gen Society may release non-personally-identifying information as part of a larger picture – e.g. by publishing a report on trends in the usage of its website; statistics of social media use by age, school, or city; and other digital device metrics for the purpose of SGS’s mission and grants or other fundraising purposes.
Gathering of Personally Identifying Information
Certain visitors to Smart Gen Society’s website choose to interact with Smart Gen Society in ways that require Smart Gen Society to gather personally identifying information. The amount and type of information that Smart Gen Society gathers depends on the nature of the interaction. Those who engage in transactions, education services, and digital wellness services with Smart Gen Society are asked to provide additional information. This information may include personal and financial information required to assist and process services and transactions. In each case, Smart Gen Society collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with Smart Gen Society. Smart Gen Society does not disclose personally-identifying information other than as described below in the Legal Disclosure section. And visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain website-related activities and services.
Smart Gen Society is COPPA compliant. This means Smart Gen Society adheres to the Child Online Privacy Protection Act and does not knowingly ask for or collect personal information from children under 13 years of age.

Cookies
A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. Smart Gen Society uses cookies to help identify and track visitors, their usage of Smart Gen Society website, and their website access preferences. Smart Gen Society visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using Smart Gen Society’s website, with the drawback that certain features of Smart Gen Society’s website may not function properly without the aid of cookies.
Protection of Certain Personally Identifying Information
Smart Gen Society discloses potentially personally identifying and personally identifying information only to those of its employees, contractors, and affiliated organizations that (i) need to know that information in order to assist and consult on Smart Gen Society’s behalf or to provide services available at Smart Gen Society’s website, and (ii) that have agreed not to disclose it to others. Smart Gen Society will not rent or sell potentially personally identifying information to anyone.
Legal Disclosure of Certain Personally Identifying Information
Smart Gen Society talks the talk, walks the walk, and follows all state and federal laws.
Smart Gen Society will make all efforts to retain identifying, confidential information, however, if compelled by law to disclose information received, Smart Gen Society will comply with such orders. Other than to its employees, contractors and affiliated organizations, as described above, Smart Gen Society discloses potentially personally identifying and personally identifying information only in response to a subpoena, court order or other governmental request, or when believes in good faith that disclosure is reasonably necessary to protect the property or rights of Smart Gen Society, third parties or the public at large. Smart Gen Society takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally identifying and personally identifying information.
In addition, Nebraska requires every adult to be a mandatory reporter. This means that if Smart Gen Society has reason to believe a minor is being abused or neglected, Smart Gen Society will report to child welfare services or law enforcement. In addition, if immediate self-harm or harm to others is a concern, Smart Gen Society will notify law enforcement, either local or federal.
Information Shared with Third Parties
Aside from the Legal Disclosure third parties stated above that would require disclosure of potentially personally identifying or personally identifying information, if you submit a credit card on Smart Gen Society’s site, Smart Gen Society will forward that information to a service that processes the payment or donation.
Aggregated Statistics
Smart Gen Society may collect statistics and metrics about the behavior of visitors to its website. Smart Gen Society is a nonprofit that relies on grants and fundraising to ensure that anyone who needs its services has access to it. These statistics and metrics are often necessary for potential grants, marketing purposes, and fundraising opportunities and will be disclosed as such. Smart Gen Society does not disclose personally identifying information other than as described above.
Business Transfers
If Smart Gen Society, or substantially all of its assets are acquired, or in the unlikely event that Smart Gen Society goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Smart Gen Society may continue to use your personal information as set forth in this policy.

Although most changes are likely to be minor, Smart Gen Society may change its Terms of Use and Privacy Policy from time to time, and in Smart Gen Society’s sole discretion.
